The terms and conditions governing your use of BITS Perth services.
By engaging BITS Perth for any service, requesting a quote, or using our website, you agree to be bound by these Terms of Service. Please read them carefully. These terms are governed by the laws of Western Australia, Australia.
BITS Perth (ABN: 92552536171) is a locally-owned IT services business operating in Clarkson, Western Australia. We provide computer and laptop repair, managed IT support, cybersecurity services, and web design and digital marketing services.

BITS Perth offers the following categories of service:
The specific scope of any service will be agreed upon in writing (including via email or quote) before work commences.
All quotes provided by BITS Perth are valid for 14 days from the date of issue unless otherwise stated. A quote is not a binding contract until accepted by the client in writing (including email confirmation).
For repair services, we provide a written quote (or verbal quote with written follow-up) after diagnosis. Work will not commence until you approve the quote. Diagnostic assessments are free of charge — you only pay if you approve the repair.
For ongoing managed services and web design plans, a formal service agreement or statement of work will be provided prior to commencement.
All prices are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. We reserve the right to adjust pricing for ongoing services with 30 days' written notice.
Invoices are due within 7 days of issue unless otherwise agreed. We reserve the right to suspend services for accounts more than 14 days overdue and to charge interest on outstanding amounts at the rate of 10% per annum.
You may cancel a repair at any time before work commences at no charge. If work has commenced and you choose not to proceed, you will be charged for the time and parts reasonably incurred up to that point. Completed repairs are non-refundable unless covered by our warranty (see Section 6).
Monthly plans may be cancelled with 30 days' written notice after the initial minimum term. No refunds are provided for the current billing period upon cancellation. Early termination during a minimum term may attract an early exit fee as specified in your service agreement.
Nothing in these terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Our services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
BITS Perth provides a 90-day warranty on all repair work covering both parts supplied and labour performed. If the same fault recurs within 90 days of the completed repair, we will rectify it at no additional charge, subject to the following conditions:
For web design and managed services, any defects or issues arising from our work will be rectified at no charge within a reasonable timeframe, as agreed in your service agreement.
When you entrust a device to BITS Perth for repair, we will only access files or data strictly necessary to diagnose or complete the repair. We will not access, copy, share or retain personal files beyond what is required. We strongly recommend backing up your data before bringing any device in for service — BITS Perth accepts no liability for data loss arising from a repair unless caused directly by our negligence.
Any business information, client lists, financial data or confidential information we may access in the course of providing managed IT services will be treated as strictly confidential and will not be disclosed to any third party without your written consent, except as required by law.
Upon full payment of all outstanding amounts and completion of any minimum term, ownership of the website's content, design and code (as created by BITS Perth specifically for you) transfers to you. This does not include third-party components (themes, plugins, stock imagery, licensed fonts) which remain subject to their respective licences.
BITS Perth retains the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.
You warrant that any content, images, text or other materials you provide to us for inclusion in your website do not infringe any third-party intellectual property rights. You indemnify BITS Perth against any claims arising from content you supply.
To the fullest extent permitted by Australian Consumer Law, BITS Perth's liability for any claim arising from our services is limited to:
BITS Perth is not liable for any indirect, consequential, incidental or special loss or damage, including loss of profits, loss of data, business interruption or reputational damage, howsoever caused.
This limitation does not apply to the extent that our liability cannot be excluded or limited under Australian Consumer Law.
By using the BITS Perth website (bitsperth.com.au), you agree to use it only for lawful purposes. You must not attempt to gain unauthorised access to our systems, transmit malicious code, or use the site in any way that could damage, disable or impair it.
The content on our website is provided for general information only. While we take care to keep information accurate and up to date, we make no warranties about its completeness or accuracy.
Our website may contain links to third-party websites or services. We are not responsible for the content, accuracy or privacy practices of those sites. Links do not constitute endorsement.

Any dispute arising from these terms or our services will first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
